Welcome to the NUST Delivery Platform, operated by Flibuy ("we," "us," or "our"). This platform is designed exclusively for students of the National University of Science and Technology (NUST) in Zimbabwe to order food and items for delivery. By accessing or using our Platform, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Platform.
To use our services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. We reserve the right to suspend or terminate accounts at our discretion, without notice, for any reason, including suspected misuse. You must be a current NUST student to register and use the Platform.
All orders are subject to availability and acceptance by us. Prices are listed in United States Dollars and may change without notice. Payment must be made in full at the time of order via approved methods. We are not liable for any payment processing errors by third-party providers. Refunds are at our sole discretion and may be denied for any reason, including but not limited to order cancellations or delivery issues.
We provide delivery logistics exclusively within NUST premises and surrounding areas. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by factors beyond our control, such as weather, traffic, or student availability. You acknowledge that we may subcontract delivery to third parties, and we disclaim liability for any issues arising from such arrangements. All deliveries are at your own risk, and you must inspect items upon receipt. No returns or exchanges are accepted once delivered.
You agree to use the Platform only for lawful purposes and in compliance with NUST policies. You are solely responsible for the accuracy of your orders and any damages caused by misuse. Prohibited activities include, but are not limited to, ordering prohibited items, harassing delivery personnel, or violating any laws. We may monitor usage and report violations to NUST authorities.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including but not limited to food spoilage, delivery delays, or health issues from consumed items. Our total liability is limited to the amount paid for the specific order in question. You use the Platform at your own risk.
All content on the Platform, including logos, text, and software, is owned by us or our licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission. Any unauthorized use may result in legal action.
We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any breach of these Terms. Upon termination, your right to use the Platform ceases, but outstanding obligations remain.
These Terms are governed by the laws of Zimbabwe. Any disputes shall be resolved exclusively in the courts of Zimbabwe. You waive any right to participate in class actions or collective proceedings.
We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms.
